Texto\" data-track-links=\"\">O empres\u00e1rio afetado pela crise provocada pelo coronav\u00edrus tem algumas alternativas para conseguir negociar o sal\u00e1rio dos empregadores ou at\u00e9 mesmo interromper o contrato de trabalho.<\/p>\n<\/div>\n<div class=\"wall protected-content\">\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"28\" data-block-id=\"2\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Uma\u00a0medida provis\u00f3ria do governo possibilita, por exemplo, a redu\u00e7\u00e3o da jornada e do sal\u00e1rio\u00a0em at\u00e9 70% \u2013 com possibilidade at\u00e9 de suspens\u00e3o dos contratos de trabalho.<\/p>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"10\" data-block-id=\"4\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\"><strong>Veja abaixo o caminho poss\u00edvel para a redu\u00e7\u00e3o de sal\u00e1rio:<\/strong><\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles\" 50% ou de 70% e vigorar por at\u00e9 90 dias. Quem tiver a jornada e o sal\u00e1rio reduzidos receber\u00e1 um aux\u00edlio do governo proporcional ao valor do seguro-desemprego.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"26\" data-block-id=\"9\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Assim, quem tiver uma redu\u00e7\u00e3o de 50% por parte da empresa vai receber uma parcela de 50% do que seria o seu seguro-desemprego caso fosse demitido.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles\" data-block-type=\"raw\" data-block-weight=\"45\" data-block-id=\"10\">\n<ul class=\"content-unordered-list\">\n<li><strong>Corte de 25% no sal\u00e1rio<\/strong>: recebe 75% do sal\u00e1rio + 25% da parcela do seguro-desemprego<\/li>\n<li><strong>Corte de 50% no sal\u00e1rio<\/strong>: recebe 50% do sal\u00e1rio + 50% da parcela do seguro-desemprego<\/li>\n<li><strong>Corte de 70% no sal\u00e1rio<\/strong>: recebe 30% do sal\u00e1rio + 70% da parcela do seguro-desemprego<\/li>\n<\/ul>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"5\" data-block-id=\"11\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\"><strong>Como fazer a negocia\u00e7\u00e3o<\/strong><\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"24\" data-block-id=\"12\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Para trabalhadores que recebem at\u00e9 tr\u00eas sal\u00e1rios m\u00ednimos,\u00a0<strong>o acordo para redu\u00e7\u00e3o de jornada e sal\u00e1rio pode ser feita por acordo individual ou coletivo<\/strong>.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"46\" data-block-id=\"13\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Para quem recebe entre<strong>\u00a0tr\u00eas sal\u00e1rios m\u00ednimos e dois tetos do INSS (R$ 12.202,12, valor de refer\u00eancia), a redu\u00e7\u00e3o de jornada e sal\u00e1rio ter\u00e1 que ser feita por acordo coletivo<\/strong>, j\u00e1 que nessa faixa a compensa\u00e7\u00e3o da parcela do seguro-desemprego n\u00e3o compensa toda a redu\u00e7\u00e3o salarial.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"18\" data-block-id=\"14\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\"><strong>Acima de R$ 12.202,12, a lei trabalhista atual j\u00e1 autoriza acordo individual<\/strong>\u00a0para redu\u00e7\u00e3o de jornada e sal\u00e1rio.<\/p>\n<p data-track-category=\"Link no Texto\" data-track-links=\"\"><a href=\"https:\/\/globoplay.globo.com\/v\/8450501\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter wp-image-9247 size-full\" src=\"https:\/\/blog.orcoma.com.br\/wp-content\/uploads\/2020\/04\/globo.jpg\" alt=\"Globo - Abrir Empresa Simples\" width=\"645\" height=\"360\" \/><\/a><\/p>\n<div class=\"mc-column content-text active-extra-styles\" data-block-type=\"raw\" data-block-weight=\"3\" data-block-id=\"17\">\n<ul class=\"content-unordered-list\">\n<li><strong>Garantia de estabilidade<\/strong><\/li>\n<\/ul>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"33\" data-block-id=\"18\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">A MP estabelece uma &#8220;garantia provis\u00f3ria&#8221; do emprego do trabalhador pelos meses em que ele tiver a jornada e o sal\u00e1rios reduzidos e por igual per\u00edodo quando as atividades e pagamentos forem normalizados.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"23\" data-block-id=\"19\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Por exemplo, se o trabalhador tiver a jornada e o sal\u00e1rio alterados por dois meses, a garantia do emprego valer\u00e1 por quatro meses.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"48\" data-block-id=\"20\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Ainda assim, o empregador continua podendo demitir o funcion\u00e1rio durante esse per\u00edodo. Por\u00e9m, se dispens\u00e1-lo sem justa causa, a medida prev\u00ea o pagamento pela empresa das verbas rescis\u00f3rias e de uma indeniza\u00e7\u00e3o. Essa regra n\u00e3o vale para casos de dispensa a pedido ou por justa causa do empregado.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"6\" data-block-id=\"21\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\"><strong>O valor desta indeniza\u00e7\u00e3o ser\u00e1 de:<\/strong><\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles\" data-block-type=\"raw\" data-block-weight=\"113\" data-block-id=\"22\">\n<ol class=\"content-ordered-list theme-ordered-list-color-primary\">\n<li>50% do sal\u00e1rio a que o empregado teria direito no per\u00edodo de garantia provis\u00f3ria no emprego, na hip\u00f3tese de redu\u00e7\u00e3o de jornada de trabalho e de sal\u00e1rio igual ou superior a 25% e inferior a 50%;<\/li>\n<li>75% do sal\u00e1rio a que o empregado teria direito no per\u00edodo de garantia provis\u00f3ria no emprego, na hip\u00f3tese de redu\u00e7\u00e3o de jornada de trabalho e de sal\u00e1rio igual ou superior a 50% e inferior a 70%; ou<\/li>\n<li>100% do sal\u00e1rio a que o empregado teria direito no per\u00edodo de garantia provis\u00f3ria no emprego, nas hip\u00f3teses de redu\u00e7\u00e3o de jornada de trabalho e de sal\u00e1rio em percentual superior a 70% ou de suspens\u00e3o tempor\u00e1ria do contrato de trabalho.<\/li>\n<\/ol>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles\" data-block-type=\"raw\" data-block-weight=\"5\" data-block-id=\"24\">\n<div class=\"content-intertitle\">\n<h2><span class=\"ez-toc-section\" id=\"Suspensao_do_contrato_de_trabalho\"><\/span>Suspens\u00e3o do contrato de trabalho<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<\/div>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"35\" data-block-id=\"25\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">O governo tamb\u00e9m passou a permitir para algumas empresas espec\u00edficas que est\u00e3o praticamente paradas a suspens\u00e3o do contrato de trabalho. Nesse caso, os trabalhadores tamb\u00e9m receber\u00e3o uma compensa\u00e7\u00e3o do governo de at\u00e9 100% do seguro-desemprego.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"45\" data-block-id=\"26\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">O prazo m\u00e1ximo para suspens\u00e3o do contrato de trabalho \u00e9 de 60 dias.
